Bivši nogometaš NK Zadra i poduzetnik Jakov Surać, koji je u lipnju 2018. godine u Zadru pretukao suradnika Nacionala i glavnog urednika portala ZADAR News, Hrvoja Bajla, na Županijskom sudu u Bjelovaru, kao drugostupanjskom u ovom slučaju, u veljači ove godine proglašen je krivim i pravomoćno osuđen na 10 mjeseci zatvora, piše Nacional. piše Nacional.
No, unatoč pravomoćnosti presude, Surać je putem svog novog odvjetnika Ive Brkića 6. lipnja 2020. podnio Zahtjev za obnovu postupka u kojemu je angažirao dvoje sudskih vještaka Josipa Škavića i Kristinu Potočki kako bi ponovno vještačili ozljedu. Oni su u svom izvještaju napisali kako na RTG snimku Bajlove ruke “ne vide nikakvu povredu, a kamoli tešku tjelesnu ozljedu”, što je u suprotnosti s prethodnim vještačkim nalazom i činjeničnim stanjem. Naime, iz RTG snimke Bajlove ruke koje ekskluzivno objavljuje Nacional.hr i laiku je vidljivo kako se radi o prijelomu, odnosno ispravno kvalificiranoj teškoj tjelesnoj ozljedi.

U prilog Bajlu ide i činjenica kako je liječnik koji je postavio inicijalnu dijagnozu na Hitnom prijemu u Općoj bolnici Zadar dr. Frane Martinis objasnio kako se radi o prijelomu ruke, odnosno teškoj tjelesnoj ozljedi, a čiju dijagnozu je detaljno na sudu potvrdio i ugledni medicinski vještak dr. Davor Mayer.
Sutkinja Teodora Projić Škovrlj požurivala Državno odvjetništvo
Znakovito je i da je Suraćev odvjetnik Zahtjev za obnovu postupka podnio 6. lipnja 2020. godine, a na njega je odgovoreno izuzetno brzo – Zahtjev za obnovom postupka odobren mu je mjesec dana od podnošenja zahtjeva, 7. srpnja 2020. Valja naglasiti i kako je sutkinja koja je donijela rješenje o obnovi postupka, Teodora Projić Škovrlj od Općinskog državnog odvjetništva iz sebi znanih razloga tražila, kako je napisala, hitnost, odnosno žurno očitovanje. Zašto se toliko žurilo sutkinji Škovrlj i u čijem je interesu to bilo, nije posve jasno.
Odgovor na to pitanje mogao bi se sam nametnuti iz činjenice da je Surać zapravo napravio sve što je bilo u njegovoj moći kako bi što je moguće prije odgodio izvršenje pravomoćne presude prema kojoj mora otići u zatvor na 10 mjeseci. Potvrđuje to i činjenica da je njegov odvjetnik, koji je tražio obnovu postupka, od Suda zatražio i odgodu izvršenja zatvorske kazne.
Kad nadležna institucila potvrdi kako se na RTG snimku radi o prijelomu, što je očito, Surać će morati u zatvor – nema novog suđenja
Ono što će se pravno događati u narednim tjednima ili danima, a to podrazumijeva termin “obnove postupka” jest da će se obrana i Sud od nadležne institucije zatražiti još jedno, dodatno vještačenje Bajlovog RTG snimka prema kojemu je jasno napisana dijagnoza i na kojoj je laiku vidljiv prijelom ruke.
Ako nadležna medinska institucija, koja će vještačiti težinu ozljede utvrdi kako je Bajlu ruka bila slomljena, Surać će morati na odsluženje kazne od 10 mjeseci zatvora i tu cijeli postupak konačno završava. Ako se utvrdi kvalifikacija ozljede na nižoj razini, postupak će krenuti iznova s novom kvalifikacijom.
Surać je Kalmetin batinaš, očekujem da će se naći iza rešetaka gdje mu je i mjesto i to vrlo brzo. Zapravo, citirat ću sutkinju Škovrlj, ‘očekujem žurno reagiranje’
U izjavi za Nacional.hr novinar Bajlo kazao je kako je tužno ono što Surać sada izvodi. Rekao je i da je uvjeren da će Surać morati na odsluženje zatvorske kazne.
“Jakov Surać, bliski suradnik, prijatelj i poslovni partner Božidara Kalmete i Zdravka Livakovića običan je batinaš koji me je izudarao jer sam pisao o njegovim šefovima. Ako se sjećate, na suđenju je prvo izjavio da ne poznaje Božidara Kalmetu. Nekoliko dana kasnije, Nacional je objavio tri godine staru audio snimku sa sjednice NO NK Zadar na kojoj je Surać kazao kako je “bio kod Kalmete i kako mu je on obećao da NK Zadar neće otići u stečaj”. Eto, on ga ne pozna, a tri godine ranije na sjednici je govorio o njemu. Nemojmo zanemariti i kako ga je Kalmeta osobno vodio kod Andreja Plenkovića na odigravanje njihove revijalne nogometne utakmice na Jarun,o čemu su pisali brojni mediji. To je čovjek kojega je Kalmeta imenovao predsjednikom Nadzornog odbora NK Zadar dok je Kalmeta bio gradonačelnik. Sa Zdravkom Livakovićem je u poslovnim odnosima i tu su stvari jasne kao dan. Možemo se prisjetiti i kako je na sudu puštena snimka Suraćevog prvog ispitivanja u policiji na kojoj je rekao kako me je udario šakom u glavu nakon čega sam ja pao na pod. Dakle, ovdje se radi o običnom nasilniku koji je odradio prljav posao za Kalmetu i njegovu mafijašku organizaciju. Ovo s obnovom postupka je također smješna stvar. Na RTG snimci jasno se vidi da mi je slomljena ruka i mišljenja sam da bi ovo dvoje vještaka koji su utvrdili kako na snimci ne vide prijelom također trebali kazneno odgovarati jer su i oni prekršili zakon. Što se same brzine obnove postupka tiče, mislim da je to što je sutkinja Škovrlj tražila od ODO-a da se žurno očituje, jer joj se očito žurilo, a za koga i za čije interese ne znam, također skandalozno samo po sebi. Sve u svemu, očekujem da će se Surać naći iza rešetaka gdje mu je i mjesto. I to vrlo brzo. Zapravo, citirat ću sutkinju Škovrlj, očekujem žurno reagiranje” – kazao je Bajlo za Nacional.hr
Pravomoćno osuđen na 10 mjeseci bezuvjetnog zatvora
Inače, presuda Suraću jedna je od rijetkih pravomoćnih presuda kojom je zbog fizičkog obračuna s novinarom napadaču izrečena bezuvjetna kazna zatvora zbog kaznenog djela protiv života i tijela, odnosno nanošenja teške tjelesne ozljede. Bjelovarski Županijski sud, nakon žalbe i Državnog odvjetništva i Suraća na prvu presudu prema kojoj je Surać bio osuđen na 10 mjeseci zatvora, ali uvjetno na tri godine, tu je presudu preinačio u dijelu koji se odnosi na izrečenu kaznu čime je prihvatio žalbu Državnog odvjetništva na taj dio prvostupanjske presude. Kako se navodi u obrazloženju, Sud “smatra da se samo takvom kaznom može postići zakonom propisana svrha kažnjavanja”. Žalbu Jakova Suraća Sud je ocijenio neosnovanom.
Novinaru ZADAR Newsa i Nacionala Hrvoju Bajlu je slomio ruku lipnju 2018.
Podsjetimo, Hrvoja Bajlu u lipnju 2018. godine Jakov Surać fizički je napao u Zadru, na Obali kneza Branimira. U napadu mu je slomljena desna ruka. Kao povod nasrtaju na sebe na parkiralištu nedaleko Gradskog mosta Bajlo je naveo svoj novinarski rad, odnosno pisanje i istraživanje kojim je dotakao samu vrhušku zadarske politike. Surać mu je tada, pričao je Bajlo, rekao “Samo ti piši o Kalmeti i Livakoviću i svima nama pa ćeš viditi. Je.. te tvoj četnički Index i Nacional. Ovo ti je samo upozorenje“ , pri čemu ga je udarao šakama i nogama dok je ovaj bio na tlu.
